People never bother reading the server news area.
As for including it or not, my understanding was that this only applies to the server version (IE distribution of the client is fine, but you may not use the mod on a server of your own).
Forsaken still has the final decision of course.

For all intents and purposes, whatever version of Itano Circus that is on ModDB is the “final” version. Pretty much anything you need on Itano Circus you can find on ModDB.
As for Flak, the “final” 2.0 release is coming up soon, but I can’t be more specific beyond that, you would have to ask Fox.

Sry but even when Forsaken denies it and Bas goes ahead and puts SW on the CD, there wouldn’t be much he could!

What the hell are you talking about Mind? For one, I doubt Bas would do that. For two, all the models and textures are legally copyrighted and would be ground enough to sue should it be deemed worthwhile.

Go ahead and do it Bas. I don’t know how much longer that mod will be tho… we’re wrapping up version 1.3 which will contain loads of awesomeness and include full Singleplayer compatibility
If you could, please have them post a link to the forum so the players will know the rules. That was the main reason we had the mod download hidden until a person registered. When a person logs in on our forum, it takes them to the rules page.
About the EULA, it was mainly for modders. I have a blurb in there about reverse engineering the mod. Or stealing parts of it without permission. While I can not really do much from a legal standpoint, I can gripe and have them blackballed among fellow modders here at TSP. If someone wants to know how to do something, all they have to do is ask. And at times, if they’re someone who is known for giving their work to others, I’ll give them my work… like Gibbon and Sushi for example.
The other reason for the EULA was to make it absolutely clear that only authorized servers are allowed to use the mod.

Well…Can you (+Fox) examine the dev time for your next mod version in weeks or months?
I don’t guess that a mag is such happy to have soonly outdated version of a modification, and in my eyes it won’t be fair to betray them this way.If you could, please have them post a link to the forum so the players will know the rules. @ Forsaken… sweeeeeeeetttttttt…. this means a fresh start over on SW:WT soon yes? I’ll admit my playtime there has been down… alot… sry… nothing to do with SW:WT i can safely say… just busy creating my own nightmare lol…
@ Bas… and anyone else with a connection to a PC mag… WE NEED MORE OF THIS!!!.. Australia’s main PC mag pulls out the FL mods every year or so… nice One page spread… think they might be fans… hehe… Last one had (fumbles in his massive PC mag pile…) Flak88, Discovery & a few others… that was about this time last year… no mods on disc though (but that part of the mag is sliding downhill… more MMO trials than mods these days… grrrrr )
I spoke to them via emails about the same time last year and got a good response about FL but that was for an XLR release… which is still many, many months away… but the interest is there… and that’s never a bad thing 8-)

Flak/Itano Circus: Can you give explicit permission to include it into magazine discs? Don’t get me wrong, but I guess the editors just want to be sure.
For me personally you showed that you are willing to, but please write this explicitly, I have sent the topic to the editors, and I am sure they want to be at the save side.

You’re forgetting the primary copyright holder here!
The mods include modded freelancer.exe and maybe also flserver.exe?
Cannot be distributed because it would bypass having to buy the game.
Am I right?
Could open a real bag of worms for everyone.
Maybe a way of patching an existing purchased Freelancer.exe, FLServer.exe etc. may be permissible?
If yes then maybe this can be done by using adoxa’s BPatchw utility with hex amendments file only, so that it is impossible to run the game without a purchased game?

Most mods don’t include all the necessary DLLs to run the game, EXEs or not.

My view is releasing anything like this in this way is blatant and insulting and would end MS’s patience and kindness.
Then they might decide to stop turning a blind eye and do something really drastic.
Why risk it by being insulting in this way?
Remember the poor woman who was sued successfully in the US earlier this year for $84,000 per track for downloading 24 tracks of music! They didn’t pick on any millionaire, just a single parent.
And I think the demo game contains all the remaining necessary files? So this would be a killer.

Another way to think about it ST is like this. Even a modified exe file is not redistributing the game. For that you would have to supply ALL the game code, there’s no mod out there that does that and if that were so , THAT would be a violation of the EULA for sure.
M$ said a few years back that they don’t care if their code gets modified as long as nobody else makes money out of except them. This applies to all their software, just look at flight simulator for example. I’ll have to find that link to their webpage where they say all this. There is no mention of modified exe files or any other game specific file, all they say is don’t modify and sell their games, they don’t mind you modifying anything as long as it’s all free.
The whole point with all these mods is that you still need a copy of FL, something that M$ still make money out of and something you still need to buy to enjoy all of these wonderful addons made by the community
